Support functions $s(h,e)=p(h\backslash e)-p(h)$ are widely used in discussion of explanation, causality and, recently, in connection with the possibility or otherwise of probabilistic induction. With this latter application in view, a rather complete analysis of the variety of support functions, their interrelationships and their "non-deductive" and "inductive" components is presented. With the restriction to two propositions, three variable probabilities are enough to discuss such problems. The analysis is illustrated by graphs, a Venn diagram and by using the Laplace Rule of (...) Succession as an illustrative example. One does not need to read many pages of this very rich book to realize that it is the fruit of a lifetime of study and that it is both speculatively wise and prudent. Though it may not receive the same degree of attention as other well publicized studies it clearly ranks with studies such as Hart's The Concept of Law and Erlich's The Sociology of Law. The author intends to develop a systematic theory of positive law, with close (...) attention to the circumstances that bring law into being, the purposes that law is designed to serve, and the structure of the legal system itself. He also proposes to apply this theory to an examination of the problems that law faces and the conditions that it must satisfy if it is to be an effective force in society. Nineteen chapters follow. Jenkins is aware that the study of law is but part of the larger study of society from which law receives its tasks and form. To determine the origin, end and functions of law is to search for those objective principles that define the conditions of man's well-being. While the first part of the book is concerned with the formulation of a general theory of law, the second explores the role of law in the social order and the conditions of legal effectiveness. Jenkins provides dramatic evidence that in our day, particularly in the United States, law is being employed for purposes that are unprecedented. "The legal apparatus," he writes, "is being asked to intervene in areas of social and personal life that have hitherto been handled by other agencies in other ways." It is the author's judgment that these nontraditional uses of law have for the most part been disappointing in their results. Neuroscientists, psychologists, educators, and management scholars propose that the current emphasis on intellect and reason in education and business over values such as love, connectedness, and compassion are at the root of many business ethical failures and societal problems. They argue not that reason should be abandoned in education and business management but rather that it needs to be balanced with values such as love because these attributes are innately human, enabling wise decision-making. This is a difficult task in (...) the context of the current ethos of intellect and reason that dominates education and management. To correct the imbalance, we must explore ways of preparing future managers to accept the relevance and importance of learning to develop and embody love. Through our research, we provide an experience of community love by creating a caring, receptive, personal container. We engaged in the practice of Collaborative Autoethnography, integrating the Nguni South African concept of Ubuntu, to explore, research, and demonstrate the experience of love in a community setting. To support this practice, we framed it against the background of integrative justice, focusing on authentic engagement without exploitative intent as per Santos and Laczniak’s (2015) Integrative Justice Model (IJM) and built upon some common contexts from which love is considered such as Catholic Social Thought (CST) and indigenous cultures. We analyzed why and how love might be implemented in education and management and how Collaborative Autoethnography can be applied in connecting with others to research, learn from, and build upon the experience of love and connectedness. The principle of liberty is distinguished from respect for auton omy. Free choice of provider would be demanded only by liberty, except that allocation of health care resources does not meet criteria for the application of liberty. Patients attempting to choose the best practitioner do not have (...) data to support the decision. If data were available, access to these superior practitioners would become an allocation problem. A mythology of the wise practitioner fosters the concept of provider choice as a personal judgement about clinical knowledge. The emerging trends of collaborative care, standardization of practice guidelines and diversity of delivery systems among reimbursers create a situation where a patient's autonomy to choose goals for treatment is respected through the choice of delivery sys tem. Girard identifies imitation, which inevita.bly issues in rivalry and violence, as the decisive force in human conduct. In primitive societies,,Jacking centralized civil authority and confronted (...) with recurrent threats to survival, a fragile social order is preserved solely by discharging violence upon an arbitrarily chosen victim. Sacraments are sometimes viewed today as something basically irrelevant to human life, an interesting spiritual "option" for those who find comfort in ritual. This view leads to a sacramental practice that is (...) occasional, irregular, or nonexistent. Many young people who fail to grasp religion as important to their reality implicitly embrace this perspective. The difficulty parishes have had in the past few years in convincing parishioners to return to liturgical prayer after each wave of the coronavirus pandemic demonstrates this viewpoint.In another perspective, the sacraments might be viewed precisely as expressions of what it means to be human, or one might say, to be human in a world in which God reveals himself at all times.1 In this view, the sacraments [End Page 1391] are our own graced self-expression as a community. They merely make thematic what already happens each moment. Alternatively, they celebrate who we are, and perhaps can be radically updated to reflect changing categories of social identity. 2Both of these viewpoints overlook the fallen state of human nature that cries out for healing from God. The first view does not preclude knowledge of human violence and fragility, but fails to recognize the sacraments as a medicine needed for the remedy of human ills. The most influential writer of the Victorine school, his work is characterized by an Augustinian concern for the re-formation of the image of God in man, a sense of the wise ordering of salvation history, and an emphasis on both virtue and liturgical practice. In his masterwork, De Sacramentis Christianae Fidei, Hugh of St. Victor divides the works of God into two main periods: the work of creation and the work of restoration. This is a new, readable but accurate translation of a minor classic in Mahayana Buddhism. The reader is helped over the terse, abstract prose of the text by timely notes from the commentator, who yet manages to let the original author speak for himself whenever possible. Probably a Chinese Buddhist of the sixth century A.D., the author was a precursor of the Consciousness Only School. Within a few pages he gives us primary reference for such familiar Mahayana notions as the (...) identification of the Buddha-Nature with "Suchness," the inexplicable origin of differentiation in "ignorance," the distinction between absolute and relative truths, the ultimate non-duality of mind and body, and the doctrine of the Triple Body of the Buddha. A sample of the argument states that we should avoid equating the Buddha Nature with empty space if we clearly understand that "empty space" is a "delusive" concept. Free from the delusion that there are physical substances, the enlightened Mind wisely refrains from positing the existence of "space" in the first place. But then, whence is ignorance? In absolute terms, the question does not arise. In relative terms, it is too confused to admit of an answer. [A] religion based on real and universal humanity."4 Astrid Oesmann, in her article "Nathan der Weise: Suffering Lessing's 'Erziehung,'" develops a similar interpretation but then, based upon it, turns a critical eye toward such a project as it requires Nathan to suppress his Judaic identity—not merely in his confrontation with Saladin but additionally by suppressing his suffering [End Page 139] at the hands of a Crusader pogrom that took the lives of his wife and seven children.5 For both these commentators, Lessing's Nathan the Wise champions a vision of a universal religion based on reason alone, for good or for ill.With this interpretation of Lessing's Nathan in the background, I intend to highlight moments in Lessing's Nathan that invite a more pluralistic reading. Both readings above interpret the ambiguous ending of the parable in light of the teleological history of revealed religion constructed by Lessing in "The Education of the Human Race" thus, implying there remains a singular, genuine, ring, i.e., a "true" religion that even may be identifiable with one of the three in question. The reading developed here interprets the ambiguous ending of the ring parable in light of the final scenes of Nathan, focusing on Recha's rich genealogical origins and her universal regard among persons of diverse faiths. The question as to which is the correct [recht] ring gives way to the question of which bearer(s) possesses a genuine [echt] ring, a significant shift in focus and reflective of Lessing's "primacy of ethics" over explanation in an approach to the plurality of revealed religions.6 Second, though both an Enlightenment reading and the present reading move the focus of religion away from orthodoxy towards a primacy of ethics, the present reading would be better equipped to respond to a charge like Oesmann's that defusing inter-religious tensions in a multicultural polity can come only by the sacrifice of one's cultural and historical particularity as Jewish, Muslim, Christian.INathan the Wise is set in Jerusalem during the close of the Third Crusade (1189–1192). A cease-fire has just been breached by the Knights Templar. Each side prepares to resume the hostilities. Previous acts of internecine violence reverberate throughout the play. The ArgumentThe societal context within which science is pursued generally acts as a productive force in the generation of knowledge. To analyze this action it is helpful to consider particular modes of mediation through which societal concerns are projected into the very local and esoteric concerns of a particular domain of research. One such mode of mediation occurs through material systems. Here I treat two such systems – the steam engine and the electric telegraph – in the natural philosophy of (...) William Thomson (Lord Kelvin).The steam engine illustratesconceptualmediation. It simultaneously instantiates “labor value” in political economy and “work” in engineering mechanics, thereby identifying the two concepts in the region of their common reference. The partial identification carries with it a structural analogy between a network of concepts from political economy and a similar network in natural philosophy, providing a potent heuristic for the reformulation and further development of dynamics.The electric telegraph illustratesmethodologicalmediation. It projects the interests of engineering and industry into the interests of electromagnetic theory and vice versa, thereby establishing, in Thomson's view, a Baconian unity of truth and utility. As the common reference of theory and practice, the telegraph locates the truth of theoretical knowledge in its utility and the utility of practical knowledge in its truth.These particular cases of conceptual and methodological mediation indicate how the local practices, concepts, and interests of a research specialty, or subculture, draw on and are adapted to those of the larger culture within which they develop. In lieu of an abstract, here is a brief excerpt of the content:Diacritics 31.1 (2001) 56-72 [Access article in PDF] Deconstruction and ZionismJacques Derrida's Specters of Marx Christopher Wise No differance without alterity, no alterity without singularity, no singularity without here-now. —Jacques Derrida, Specters of Marx Introduction Following Jacques Derrida's first sustained critique of Marx and Marxism in Specters of Marx: The State of the Debt, the Work of Mourning, and the New International (1994), an expanded version of his (...) lectures delivered at the University of California, Riverside, in May 1993, numerous "Marxist" theorists have responded to his provocative (and, for some, "untimely") intervention. Several of these critical responses have been gathered in Michael Sprinker's volume Ghostly Demarcations: A Symposium on Jacques Derrida's "Specters of Marx" (1999), which includes contributions from such diverse theorists as Pierre Macherey, Antonio Negri, Fredric Jameson, Terry Eagleton, Aijaz Ahmad, and many others. Important omissions from Sprinker's book include Gayatri Chakravorty Spivak's "Ghostwriting" (1995), an essay that Derrida nonetheless comments upon in his response "Marx & Sons," or any other feminist analysis of Specters of Marx, a curious absence in a text so riveted by questions of patriarchal affiliation. An even more startling omission from Sprinker's book is any analysis of Derrida's discussion of the Middle East, especially his remarks on the State of Israel and "a certain Jewish [i.e. Zionist] discourse on the Promised Land" [Specters of Marx 60] ("un certain discours juif de la Terre" [Spectres de Marx 104]). The myopic range of Marxist critiques of Specters of Marx is regrettable insofar as both Derrida and his Marxist critics ostensibly offer "radical" or "oppositional" perspectives on George H. W. Bush's New World Order while ignoring imperialist practices in places like Jerusalem, Golan Heights, the West Bank, and the Gaza Strip. In The End of the Peace Process (2001), Edward W. Said observes, "[w]hen one considers the broad lines of Jewish philosophy from [Martin] Buber to [Emmanuel] Levinas and perceives in it an almost total absence of reflection on the ethical dimensions of the Palestinian issue, one realizes how far one has to go" [208]. Said does not include Derrida in this trajectory of Jewish philosophers, possibly because Derrida has repeatedly disavowed any explicit affiliation with Judaism as religion, but I will argue here that Derrida's disavowal is implausible if not altogether disingenuous. In Ghostly Demarcations, Marxist responses to Derrida reveal how little real progress has been made in Western literary theory since the early 1980s, when now-tired debates about the Yale School echoed in nearly every humanities' corridor in the [End Page 56] United States. There are surely more compelling reasons to read Derrida today than to settle old scores with Ithaca-Irvine varieties of deconstruction. A key goal of this article is to enunciate Derrida's elision of the Palestinian question, not so much to undermine Specters of Marx, but to extend its power by venturing into domains that Derrida himself refuses to explore, a factor that weakens without totally disabling his deconstruction of Marxist theory. 1 The Rhetoric of Alterity In Specters of Marx, Derrida offers a complex, challenging, and virtuostic evaluation of Marx, focusing largely on "The Communist Manifesto" and The German Ideology. In particular, Derrida fixes his attention upon Marx's hostile and allegedly "obsessive" critique of Max Stirner, a rival Hegelian and "egological" anarchist. Derrida's criticisms of Marx turn on questions of spectrality, a suggestive way of describing the process whereby alienated or reified objects project illusory autonomy back upon the human subject. For purposes of the present essay, I draw attention to the rhetorical dimensions of the exchange between Derrida and his Marxist interlocutors, rather than the many subtleties implied by their respective analyses of this "new" concept formation. Such a strategy is useful not only because Derrida himself relies upon it in his essay "Marx & Sons," but also because it reveals key assumptions held by Derrida about deconstruction's political value, especially in the Middle East. This study offers a new perspective on the much-discussed debate between French phenomenologist Jean-Luc Marion and postructuralist theorist Jacques Derrida on the question of ‘negative theology’ and the Christian mystical tradition. It argues that Marion's critique of Derrida betrays a fundamental misunderstanding, specifically, that it fails to recognise that Derrida is not interested in negative theology qua theology, but rather as a discursive practice with certain resources for the performative ‘unsaying’ of logocentric systems. It continues to show that Derrida's principal (...) object is not the God of apophatic theology, but the broader, juridico-political implications of all ‘transcendental signifieds’. Finally, it suggests that Marion's oversight of these facts in his defence of the apophatic tradition unwittingly legitimates Derrida's critique, to the extent that it insulates the Christian tradition from external criticism, and thereby limits the responsiveness of that tradition to the demands of justice. Film is a powerful medium that can influence audience’s perceptions, values and ideals. As filmmaking evolved into a serious art form, it became a powerful tool for telling stories that require us to re-examine our ideology. While it remains popular to adapt a literary novel or text for the screen, filmmakers have more freedom to pick and choose the stories they want to tell. This freedom allows filmmakers to explore narratives that might otherwise go unheard, which include stories that feature (...) marginal figures, such as serial killers, as sympathetic protagonists, which is what director Patty Jenkins achieves in her 2003 film Monster. Charlize Theron’s transformation into and performance as Aileen Wuornos, and Jenkins’s presentation of the subject matter, make this film an example of rogue cinema. In addition, Aileen Wuornos is portrayed as a clear example of the rogue character. This character trope frequently defies social standards, suffers from past trauma, is psychologically complex, and is often exiled. As a prostitute and social outcast, Aileen Wuornos exists on the fringes of society and rejects the hegemonic power structure and later heteronormativity of society, which makes her a rogue figure. While there are several aspects to consider when analyzing Jenkins’s film, my intention is to argue that this film is an example of rogue cinema because of its content. In order to accomplish this task, I examine Theron’s bodily transformation and her performance as Wuornos. Furthermore, I look at how Jenkins handles the depiction of romantic love and gendered violence and argue that her treatment of this content renders this film rogue. (shrink)

A relation between Sartre's phenomenological ontology and the German idealist tradition is frequently assumed in the secondary literature on Sartre. The literature that confronts this question usually adopts a piecemeal approach, treating individual philosophers, usually Hegel, in the mode of comparison and contrast. This approach, though fruitful in a limited fashion, obscures the broader question of Sartre's relation to German idealism as a whole. This study attempts to place Sartre in the context of an internal debate within idealist thought, as (...) one player in an ongoing dialogue. Its task is the establishment of Sartre's phenomenological ontology in Being and Nothingness as essentially idealist in both form and content. ;This work proceeds primarily through interaction with primary texts, beginning with Sartre's early piece, Imagination: A Psychological Critique. From this book we abstract a critical methodology that we discover is ubiquitous in Sartre's early works. In particular, we examine the application of it to the idealists in Being and Nothingness, learning both its failures in terms of representational accuracy and its successes in advancing Sartre's argument. These discoveries lead us to explore the distinction Sartre draws between metaphysics and ontology, which is critical to understanding the nature of Sartre's entire project. Having clarified this distinction, we return our attention to the critical methodology, which displays both an intimate connection to, and important distinctions from, Hegel's dialectical logic. Notably, if Sartre's position is best understood as an ongoing 'moment' in the developing narrative of idealist thought, we conclude that the profound nature of Sartre's relation to Hegel is that of opposition. Sartre's opposition to Hegel in turn may be seen as analogous to the Kantian project of establishing intellectual space for ethics in the face of scientific rationalism. Sartre, I argue, reinstitutes Kant's "Copernican revolution" on the ontological level as a response to the necessitarianism issuing from Hegel's dialectical logic. This response intends to place the realm of ethics forever beyond the possibility of doubt by forbidding metaphysical speculation any functional relevance to human existence. Nursing has improved over the centuries from the physician's handmaiden to a recognised profession. Yet, the image of a nurse is often associated with notions of caring and nurturing‐ attributes considered feminine. Indeed, cultural, and societal biases exist that can deter men from entering the nursing profession where their sense of masculinity is questioned. Several studies have highlighted the existence of gender‐based stereotypes, stigma, rejection, loneliness and discrimination which impact the retention of men in the nursing profession. Despite the established (...) evidence regarding negative experiences, it appears limited attention has been paid to the men who decide to stay in nursing: how do they thrive in a profession wherein biases are evident within and in the wider societal context? Undoubtedly, several factors such as job security and financial incentives may contribute to men remaining in nursing. Beyond these, we borrow the notion of ‘constructive resistance’ to underscore that though the biases may be apparent, male nurses are able to construct alternatives that accommodate the image of a man in the nursing profession. Strategies such as developing the image as a ‘super nurse’ can create opportunities for male nurses to be preferred by other healthcare providers as well as female nurses. Thus, although resistance may usually appear as a negative phenomenon, constructive resistance represents hidden advantages which offers an opportunity to retain male nurses. These need to be highlighted and explored more as they can offer deeper insight into strategies that can be employed to improve retention and representation of men in nursing particularly at a time when the impact of nursing shortage remains a global issue. During the past decade, a new term has entered the medical/legal lexicon : maternal-fetal conflict. Implicit in the terminology is the assumption that a pregnant woman and her fetus have separate and competing rights. This concept has stimulated extensive legal and ethical debate, primarily in the context of medical interventions forced on unwilling pregnant women, and in corporate efforts to bar fertile women from hazardous jobs. On one side of the debate are the proponents of the future child's right to (...) be born of sound mind and body, and society's interest in the delivery of healthy newborns. On the other side, are advocates of a woman's right to reproductive autonomy, bodily integrity, due process, confidential medical treatment, and freedom from gender discrimination. Physicists regularly invoke universal laws, such as those of motion and electromagnetism, to explain events. Biological and medical scientists have no such laws. How then do they acquire a reliable body of knowledge about biological organisms and human disease? One way is by repeatedly returning to, manipulating, observing, interpreting, and reinterpreting certain subjects—such as flies, mice, worms, or microbes—or, as they are known in biology, “model systems.” Across the natural and social sciences, other disciplinary fields have developed canonical examples that (...) have played a role comparable to that of biology’s model systems, serving not only as points of reference and illustrations of general principles or values but also as sites of continued investigation and reinterpretation. The essays in this collection assess the scope and function of model objects in domains as diverse as biology, geology, and history, attending to differences between fields as well as to epistemological commonalities. Contributors examine the role of the fruit fly Drosophila and nematode worms in biology, troops of baboons in primatology, box and digital simulations of the movement of the earth’s crust in geology, and meteorological models in climatology. They analyze the intensive study of the prisoner’s dilemma in game theory, ritual in anthropology, the individual case in psychoanalytic research, and Athenian democracy in political theory. The contributors illuminate the processes through which particular organisms, cases, materials, or narratives become foundational to their fields, and they examine how these foundational exemplars—from the fruit fly to Freud’s Dora—shape the knowledge produced within their disciplines. When successful and ethical managers are alerted to possible organizational wrongdoing, they take corrective action before the problems become crises. However, recent research [e.g., Rynes et al. (2007, Academy of Management Journal50(5), 987–1008)] indicates that many organizations fail to implement evidence-based practices (i.e., practices that are consistent with research findings), in many aspects of human resource management. In this paper, we draw from years of research on whistle-blowing by social scientists and legal scholars and offer concrete suggestions to managers who (...) are interested in encouraging internal reporting of problems requiring attention, and to observers of questionable activity who are considering reporting it. We also identify ways that research suggests policy-makers can have a more positive influence. We hope that these suggestions will help foster evidence-based practice regarding whistle-blowing.
